Enrollment Agreement

The United States Health Qigong Association  (the “USHQA") provides Qigong instruction through in-person and virtual online classes.

 

The following Terms and Conditions form the Agreement between the USHQA and the Client.

DEFINITIONS

  1. STUDENT. A student is the individual enrolled to receive instruction from the USHQA.

  2. CLIENT. The Client is a student or the parent or legal guardian of a student who is not an adult.

  3. CLASS. A Class is one session of instruction offered online or in-person.

  4. PROGRAM. A program is:

    1. a one-time seminar comprised of one class,

    2. a seminar series comprised of multiple classes, or

    3. an ongoing series of classes in Qigong.

  5. ENROLLMENT PERIOD.  The Enrollment Period is:

    1. the time between the start and end date of a Seminar Series, or

    2. the agreed enrollment start and end date for attending an agreed number of classes in an ongoing series of classes.

 

FITNESS TO PARTICIPATE

  1. It is the Client’s responsibility to ensure the student is mentally and physically fit to participate in the Program or Programs for which he or she is enrolled.

  2. It is the student’s responsibility while participating in a class to advise the instructor if they feel discomfort or have a concern about following the instructions.

 

ONLINE INSTRUCTION

  1. Online instruction may be used to replace in-person instruction when in-person instruction is cancelled due to circumstances beyond The USHQA's control.  Such circumstances may include but are not limited to government instructions to close public venues or to limit size of gatherings due to health safety concerns.

  2. The USHQA is not obligated to reschedule classes disrupted due to Internet or network performance issues.

PROGRAM CANCELLATION & SUBSTITUTIONS

  1. The USHQA reserves the right to cancel a Program if registrations fall below minimum thresholds.  See Payment & Refund Policy for refund details.

  2. The Academy reserves the right to cancel a students’ participation in a Program if their behavior is deemed to:

    1. pose a risk to the Student’s or a classmate’s safety, or

    2. interfere with classroom instruction.

 

PAYMENT & REFUND POLICY

  1. Student enrollment is complete when payment funds are deposited to The USHQA's bank account.

  2. Enrollment may be cancelled by the Client without penalty or further obligation within three (3) days of purchasing a program.          

  3. If a Program is cancelled, the Client will be offered a full refund less:

    1. any pro-rated value of classes provided prior to cancellation, or when applicable,

    2. the prorated value of the months expired on the enrollment period if that value is greater than the value of the classes attended.

  4. A fee of fifteen dollars ($15) will be charged for:

    1. any payments fourteen (14) days past due, or

    2. payments processed through an automatic clearinghouse (ACH) against accounts with insufficient funds.

  5. Failure of the Student to complete the number of classes contemplated during the Enrollment Period does not relieve the client of their obligation to pay the tuition in full.

  6. In the event the Student attends the agreed number of classes before the Enrollment Period expires,

    1. the Student may no longer attend classes until re-enrolled for a new enrollment period, and

    2. the Client must pay the balance in full before the student may be re-enrolled if the Client is paying through an installment plan.

 

LIMITATION OF LIABILITIES

  1. The client waives any and all claims for injury to the Student or damage to property that is not the result of willful negligence of USHQA instructors and releases the USHQA and USHQA instructors from any and all liability for any loss, damage, expense or injury the student may suffer.

  2. The Client releases the USHQA , and the USHQA's affiliates, licensors, suppliers, subsidiaries, parents or other legal representatives, from any claims, demands, damages or other legal action which may arise from the Client’s dispute with any other Client.

 

THE CLIENT AGREES TO BE BOUND AND ABIDE BY THESE TERMS AND CONDITIONS AND ANY AMENDMENTS THERETO IF THE STUDENT PARTICIPASTES IN ANY OF THE ACADEMY’S IN PERSON OR ON-LINE PROGRAMS.

JURISDICTION

 

These Enrollment Terms and Conditions shall be governed by and construed in accordance with the internal laws of the State of Virginia.
